These Terms and Conditions ("Agreement") apply to your use of the website operated by Belmonds Hotels Private Limited (“Belmonds”, “we”, “our”, or “us”), accessible at www.belmondshotels.in (the “Site”). By accessing or using our Site and services, you agree to be bound by this Agreement. If you do not agree to these Terms, please do not use our Site or services.
1. Acceptance of Agreement
By using this Site, you accept the terms outlined here, forming a binding contract between you and Belmonds. This Agreement is the complete understanding between you and Belmonds regarding your use of the Site, superseding any prior agreements or communications.
Belmonds reserves the right to revise or update these Terms at any time without specific notice. The updated Agreement will be made available on this page, and continued use of the Site implies acceptance of the changes.
2. Use of Website
Belmonds Hotels grants you a limited, non-exclusive, non-transferable, and revocable license to use our Site for personal and non-commercial use only.

3. Booking Services
All hotel bookings are subject to availability and confirmation.
Booking confirmation will be sent via email or WhatsApp.
Check-in and check-out policies, and cancellation rules, are governed by the respective hotel or accommodation provider.
You agree to provide accurate information when booking, including valid identification during check-in.
4. Editing, Deleting, and Modification
We reserve the right, at our sole discretion, to edit, modify, or delete any information, content, or service offering on the Site without prior notice.
5. External Links Disclaimer
Our Site may contain links to third-party websites. Belmonds does not operate or control these websites and is not responsible for the content, accuracy, legality, or opinions on these sites. Use of any linked website is at your own risk.
The inclusion of third-party links does not imply endorsement or affiliation by Belmonds.
6. No Warranties
All services, information, and materials on this Site are provided “as is” and “as available.”
We do not warrant:
That the website will be error-free or uninterrupted

Belmonds expressly disclaims all warranties, including implied warranties of merchantability or fitness for a particular purpose.
7. Limitation of Liability
To the fullest extent permitted under applicable law:
Belmonds Hotels will not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Site or bookings made through it.
Our maximum liability, if any, shall be limited to the total value of the booking made by you.
You acknowledge and agree that your sole remedy for dissatisfaction with the Site is to stop using it.
8. Intellectual Property
All content on this website (logos, text, images, graphics, etc.) is the property of Belmonds Hotels Private Limited or its partners and is protected by copyright and trademark laws.

9. Governing Law & Jurisdiction
This Agreement is governed by the laws of India. You agree to submit to the exclusive jurisdiction of the courts of New Delhi, India, for any disputes related to these Terms.
We do not guarantee that the content on this Site complies with laws outside of India. Users accessing the Site from other locations do so at their own risk.
10. Severability
If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remainder shall remain in full force.

12. Terms Policy Changes
Belmonds reserves the right to revise, update, or modify these Terms & Conditions at any time. Any changes will be posted on this page. Your continued use of the website constitutes acceptance of those changes.
Belmonds Holiday Package Luxury (BHPL) – Terms & Conditions
1. DECLARATION
The Management of Belmonds Hotels Pvt. Ltd. reserves the right to accept or reject any application for the Belmonds Holiday Package Luxury (BHPL) without assigning any reason.
Any obligation of the Company shall commence only upon acceptance of the application and issuance of a confirmation by the Company.
The Applicant(s) agree(s) that persons using the facilities under the BHPL are bound by and shall comply with the Package Rules, the rules and regulations of the Company (as amended from time to time), and the rules and regulations of the respective facilities.
If the application is rejected, all monies paid shall be refunded without interest.
2. DEFINITIONS
2.1 Company – Belmonds Hotels Pvt. Ltd., having its registered office at “Address”, incorporated under the Companies Act, 1956, including successors and assigns.
2.2 BHPL (Belmonds Holiday Package Luxury) – A holiday package of six nights and seven days (accommodation only) at premium locations in India and abroad.
2.3 Client – Any person/company/firm applying for BHPL by executing the prescribed application form.
2.4 Membership Fee – The total cost payable towards BHPL, as per the option chosen and pricing determined by the Company.
2.5 Day/Night – The interval between check-in time of one calendar date and check-out time of the subsequent calendar date.
Blackout Days: 20th December to 10th January.
2.6 Down Payment – The minimum upfront booking fee paid by the Client for BHPL.
2.7 Facilities – Accommodation at affiliated resorts, clubs, and other listed properties as updated by the Company on its website.
2.8 Customer – Any person/company/firm in whose name a Confirmation Receipt is issued after realization of the full amount.
2.9 Taxes – Applicable taxes/levies imposed by Central/State/Local Authorities.
2.10 Membership Plan – Refers to BHPL benefits and discounted rates outlined in Clause 6 of this agreement.
2.11 Rules – The Membership Admission Rules and Membership Usage Rules, as framed and updated by the Company from time to time.
3. MEMBERSHIP TERMS
Membership under BHPL is non-transferable and valid only in the name of the registered Customer.
The Membership becomes active only upon full payment and issuance of a Confirmation Receipt.
Members must adhere to the rules of the Company and affiliated properties during their stay.
4. HOLIDAY PRIVILEGES
Each membership entitles the Customer to 6 Nights / 7 Days accommodation at premium properties in India or abroad.
Holidays are subject to:
Room availability.
Blackout Days (20th Dec – 10th Jan).
Prior reservation requirements.
Accommodation is on a “room-only” basis unless specified. Food, transport, activities, and other services are charged separately.
5. PAYMENT TERMS
Membership is confirmed only after realization of the full membership fee.
Down Payment must be made as per Company’s policy to initiate booking.
The Company reserves the right to cancel any booking if payments are delayed.
Taxes are payable as per prevailing government regulations.
6. USAGE RULES
Reservations must be made through the Company’s official channels (website, customer care, or designated booking agents).
Members must present valid ID proof at the time of check-in.
Unused nights cannot be carried forward unless otherwise mentioned in the package.
The Company reserves the right to substitute a property with another of similar standard if required.
7. TERMINATION & CANCELLATION
The Company may terminate membership if:
False information was provided during registration.
Rules and regulations are violated.
Payments remain unpaid.
Cancellations by the Customer are subject to the Company’s refund and cancellation policy.
The Company is not liable for any refunds on unused holidays due to Customer’s failure to utilize the package within the validity period.
8. GIFTING & TRANSFERS
Holidays under BHPL may be gifted to family or friends, provided prior intimation is given to the Company.
Gifting is subject to approval and cannot be used for resale or commercial purposes.
9. COMPANY’S RIGHTS
The Company reserves the right to:
Modify package rules, pricing, and terms at any time.
Substitute resorts/facilities due to operational reasons.
Deny reservations in case of misuse or fraudulent activity.
10. LIMITATION OF LIABILITY
The Company is not responsible for:
Loss, injury, accident, or delay occurring during the holiday.
Services not directly provided by the Company (e.g., airline, transport, third-party vendors).
Liability is limited only to the value of the membership purchased.
11. ARBITRATION & JURISDICTION
Any dispute arising from BHPL shall be subject to arbitration under the Arbitration and Conciliation Act, 1996.
The place of arbitration shall be New Delhi, India.
Courts at New Delhi shall have exclusive jurisdiction over any legal proceedings.
12. ACKNOWLEDGEMENT
By enrolling in the Belmonds Holiday Package Luxury (BHPL), the Customer acknowledges that:
They have read, understood, and accepted the above Terms & Conditions.
They agree to comply with the rules of the Company and affiliated facilities.
The membership benefits are limited strictly to the terms mentioned herein.
